Set Public Hearing For <br /> Cl~~ CONTINUED TO <br /> ~s- FILE NUMBER <br /> CITY MANAGER <br /> RECOMMENDED ACTION <br /> Authorize the City Manager and Clerk of the Council to execute an agreement with T & B <br /> Planning in the amount not-to-exceed $95,274 to prepare an Environmental Impact Report for <br /> the San Lorenzo Sewer Lift Station project. <br /> DISCUSSION <br /> In March 2008, the City solicited proposals from preapproved environmental firms to conduct an <br /> environmental study and prepare a Mitigated Negative Declaration for construction of the San <br /> Lorenzo Sewer Lift Station (Exhibit 1). T & B Planning was the highest-rated firm with the lowest <br /> fee and they were awarded the contract. <br /> On February 2, 2009, City Council approved the Mitigated Negative Declaration for the San <br /> Lorenzo Sewer Lift Station Improvements. At the same meeting, Council adopted a resolution <br /> authorizing condemnation of a small portion of unused property located at 2909 S. Bristol Street <br /> as necessary to construct the project. The property owner subsequently brought suit against the <br /> City in an effort to stop the project. As a result of this litigation the Court has directed the City to <br /> prepare an Environmental Impact Report (EIR) to further investigate the impacts of the proposed <br /> improvements. <br /> Staff recommends that T & B Planning be retained as they are a qualified and reputable firm <br /> familiar with the project and have already performed much of the preliminary work necessary to <br /> complete the EIR. <br /> ENVIRONMENTAL IMPACT <br /> There is no environmental impact associated with this action. <br /> 25E-1 <br /> <br />
