FIRST AMENDMENT TO <br /> COOPERATNE AGREEMENT BETWEEN <br /> THE CITY OF SANTA ANA AND <br /> THE SANTA ANA HOUSING AUTHORITY <br /> This First Amendment to the Cooperative Agreement ("Amendment"} is hereby <br /> entered into this day of , 2010, by and between the City of Santa Ana <br /> ("City"} and the Santa Ana Housing Authority {"Project Sponsor"). <br /> RECITALS: <br /> A. City, on behalf of all jurisdictions in Orange County, has been designated to <br /> receive grant funding provided by the U.S. Department of Housing and Urban <br /> Development ("HUD"} pursuant to the Housing Opportunities for Persons With AIDS <br /> ("HOPWA"} Program, and City has entered into a HOPWA grant agreement with HUD. <br /> B. City and Project Sponsor entered into the "Cooperative Agreement Between <br /> the City of Santa Ana and the Santa Ana Housing Authority" ("Cooperative Agreement") <br /> on July 1, 2009, whereby the Project Sponsor has provided leadership and is responsible <br /> for planning and providing comprehensive HIV services for clients throughout Orange <br /> County. Project Sponsor also maintains the wait list for the program, and provides <br /> services to support the Tenant-Based Rental Assistance Program consisting of financial <br /> eligibility of tenants, HQS inspections, and financial responsibility for housing assistance <br /> <br /> payments to landlords. <br /> C. Due to increases in Housing Assistance Payment costs, the parties desire to <br /> amend the Cooperative Agreement, adding an additional One Hundred Ten Thousand <br /> <br /> Dollars to the Cooperative Agreement. <br /> WHEREFORE, in consideration of the mutual and respective covenants and promises <br /> contained in the Agreement, and subject to ail the terms and conditions of the Agreement, <br /> City and the Project Sponsors agree as follows: <br /> 1. The Cooperative Agreement shall 6e amended to include in Section III. Budget, <br /> an additional One Hundred Ten Thousand Dollars ($110,000) in Housing <br /> Assistance Payments/Program Expense for a total Maximum Obligation of Six <br /> Hundred Ten Thousand Dollars {$610,000). <br /> 2. Except as hereinabove rriodified, the terms and conditions of the Agreement <br /> remain in full force and effect. <br /> 1 Exhibit 1 <br /> <br />
