. <br /> <br /> REQUEST FOR <br /> <br /> COUNCIL ACTION - <br /> a <br /> CITY COUNCIL MEETING DATE: CLERK OF COUNCIL USE ONLY: <br /> APRIL 19, 2010 <br /> TITLE: APPROVED <br /> COOPERATIVE AGREEMENT FOR As Recommended <br /> THE NEWPORT BAY WATERSHED As Amended <br /> Ordinance on 1S` Reading <br /> MANAGEMENT AREA Ordinance on 2"d Reading <br /> Implementing Resolution <br /> Set Public Hearing For <br /> CONTINUED TO <br /> , <br /> L--r~ ~ FILE NUMBER <br /> i <br /> CITY MANAGER <br /> RECOMMENDED ACTION <br /> Authorize the City Manager and Clerk of the Council to execute the attached cooperative <br /> agreement with the County of Orange to participate in the management of the Newport Bay <br /> Watershed Management Area and to become a member of the Executive Committee. <br /> DISCUSSION <br /> The Newport Bay watershed encompasses a drainage area of approximately 154 square miles <br /> including all or portions of the cities of Tustin, Newport Beach, Irvine, Lake Forest, Santa Ana, <br /> Costa Mesa, Orange, Laguna Hills, and Laguna Woods. Approximately 75 percent of Santa Ana <br /> drains to the Newport Bay via the Santa Ana Delhi Channel. <br /> The Federal Clean Water Act (FCWA) requires states to identify all seriously polluted or <br /> "impaired," water bodies. In California, the State Water Resources Control Board (SWRCB) sets <br /> maximum pollutant levels that impaired water bodies can receive. The Newport Bay Watershed <br /> has been identified as an impaired water body by the SWRCB. To meet maximum pollutant level <br /> requirements, treatment technologies and best management practices (BMPs) must be put in <br /> place within the watershed. <br /> A cooperative agreement for the management of the Newport Bay watershed was created with the <br /> main purpose of providing a management framework for parties within the watershed. The County <br /> of Orange is the lead agency for the committee and establishes a budget annually based on the <br /> requirements from the SWRCB. The FY 2010-11 budget for the entire program is $1.417 million. <br /> Each party's share is based on a formula that uses population and total area that contributes to <br /> the watershed. Santa Ana's share is calculated to be 12.24 percent or $200,000. <br /> 25B-1 <br /> <br />
