<br />31. Will comply with the minimum wage and maximum hour provisions of the <br />Federal Fair Labor Standards Act (29 U.S.C. 201), as they apply to employees of <br />institutions of higher education, hospitals, and other non-profit organizations. <br /> <br />32. Will comply, as applicable, with the provisions ofthe Davis-Bacon Act (40 <br />V.S.c. Section 276a to 276a-7), the Copeland Act (40 V.S.C. Section 276c and 18 V.S.C. <br />Sections 874), and the Contract Work Hours and Safety Standards Act (40 V.S.C. <br />Sections 327-333), regarding labor standards for Federally assisted construction sub- <br />agreements. <br /> <br />33. Agrees that: <br />a. No Federal appropriated funds have been paid or will be paid, by or on behalf <br />of the undersigned, to any person for influencing or attempting to influence an officer or <br />employee of any agency, a Member of Congress, an officer or employee of Congress, or <br />an employee of a Member of Congress in connection with the making of any Federal <br />grant, the entering into of any cooperative agreement, and the extension, continuation, <br />renewal, amendment, or modification of any Federal grant or cooperative agreement. <br />b. If any other funds than Federal appropriated funds have been paid or will be <br />paid to any person for influencing or attempting to influence an officer or employee of <br />any agency, a Member of Congress, an officer or an employee of Congress, or employee <br />of a Member of Congress in connection with the Federal grant or cooperative agreement, <br />the undersigned shall complete and submit Standard Form LLL, "Disclosure of Lobbying <br />Activities," in accordance with its instructions. <br />c. The undersigned shall require that the language of this certification be included <br />in the award documents for all sub, aWards at ,all tiers including sub grants, contracts under <br />grants and cooperative agreemen~s~andspbcontract(s) and that all sub recipients shall <br />certify and disclose accordingly.' <br />d. This certification is a material representation of fact upon which reliance was <br />placed when this transaction was made or entered into. Submission of this certification is <br />a <br />prerequisite for making or entering into this transaction imposed by section 1352, Title <br />31, V.S. Code. Any person who fails to file, the required certification shall be subject to a <br />civil penalty of not less than $10,000 and ,not more ~han $100,000 for each such failure. <br /> <br />34. Agrees that equipment acquired or obtained with grant funds: <br />a. Will be made available pursuant to applicable terms of the California Disaster <br />and Civil Defense Master Mutual Aid Agreement in consultation with representatives of <br />the various fire, emergency medical, haz~dous materials response services, and law <br />enforcement agencies within the jurisdiction of the applicant, and deployed with <br />personnel trained in the use of such equipment in a manner consistent with the California <br />Law Enforcement Mutual Aid Plan or the California Fire Services and Rescue Mutual <br />Aid Plan. <br />b.
