CITY has been designated a Local Workforce Investment Area (LWIA) under <br />the Workforce Investment Act of 1998, Public Law 105-220 ("the Act"). <br />B. The State of California has created the LWIA to administer the Act programs <br />operated by the State of California pursuant to the Act. <br />C. As a LWIA, CITY is entitled to receive federal funds to establish programs to <br />increase training opportunities for unemployed individuals and also to preserve and create jobs. One <br />goal of California's Workforce Investment System is to provide the opportunities to achieve career <br />goals that will allow individuals to successfully compete in the labor market and prepare them for <br />higher education. <br />D. The American Recovery and Reinvestment Act of 2009 (the "Recovery Act") <br />includes provisions for WIA Adult and Dislocated Worker funds, WIA Youth funds including summer <br />youth employment activities, and Wagner-Peyser Act funds for reemployment services. <br />E. CONTRACTOR has experience in offering education, occupational <br />development, business training, lay-off aversion and employment programs for the labor market <br />participants in the City of Santa Ana ("said program"). <br />F. CONTRACTOR is willing to operate said program pursuant to the Act and <br />California law. <br />WHEREFORE, for and in consideration of the respective and mutual covenants and <br />promises hereinafter contained and made, and subject to all the terms and conditions hereof, the parties <br />hereto do hereby agree as follows: <br />I. <br />CONTRACTOR'S OBLIGATIONS <br />A. CONTRACTOR agrees to provide the following services pursuant to said <br />program, as more specifically set forth in CONTRACTOR'S program narrative contained in "Exhibit <br />Page 1 of 15 <br />
