4. Procedures for Handling Handicap Complaints by Participants <br />Complaints alleging discrimination on the basis of handicap will be filed and processed under <br />the Department of Labor regulations implementing Section 504 of the Rehabilitation Act of 1973 <br />at 29 Code of Federal Regulations Section 32. <br />1. Complaints must exhaust the Santa Ana LWIA's informal resolution procedures <br />before filing their complaint with OCR. <br />2. Complainants will be made aware of the 180 days requirement in which to file his/her <br />complaint. <br />A. Procedures at the LWIA Level <br />The complainant shall file his/her complaint directly with the Santa Ana LWIA. Upon <br />receipt of the complaint, the EEO Officer shall investigate and gather information <br />concerning the complaint. <br />2. An informal conference will be held with the parties concerned in an effort to resolve the <br />issue(s). The complainant has the right to be present and may be represented during <br />the conference. <br />3. The Santa Ana LWIA shall issue in writing its decision to the complainant no later than <br />thirty (30) days after the filing of the complaint., <br />B. Procedures at the State Level <br />1. The complainant may appeal to the State if he/she is not satisfied with the decision of the <br />Santa Ana LWIA. <br />2. The Complainant must file his/her appeal as a request for review directly with the Chief <br />WID within ten (10) calendar days after the receipt of the Santa Ana LWIA's decision. <br />3. The Chief-WID, shall issue a decision no later than thirty (30) calendar days after receipt <br />of the request for review. <br />4. After the complainant has received a decision or no decision has been received from the <br />Director of Employment Development Department (on behalf of the Governor), the <br />complainant has the right to appeal his/her complaint within thirty (30) calendar days to <br />the Office of Civil Rights (OCR} with the Department of Labor. <br />16 <br />~vuioi-r n <br />
