(hereinafter "Contractor"), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California (hereinafter "City"). E) RECITALS: -(-t 4 A. The parties entered into Agreement # A-2007-016, dated January 16, 2007, J (hereinafter "said Agreement"), later amended by Agreement # A-2007-016-01, dated July 1, 2007, by which Consultant has provided commissary services for the Santa Ana Detention Center inmates. B. In accordance with the terms and conditions of said Agreement, the parties wish to again amend said Agreement to provide that the Contractor will expand commissary delivery, deposit services, a family ordering website, and all applicable regulations for the inmate commissary. C. In addition, in accordance with the terms and conditions of said Agreement, the parties wish to renew said Agreement for an additional one-year period. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Second Amendment to Agreement, the parties agree as follows: 1. Section 1, SCOPE OF SERVICES, shall be amended to include additional services for Contractor to perform as set forth in Attachment 1 to this Agreement 2. Section 3, TERM, shall be amended to extend the termination date one year, from January 31, 2010, through January 31, 2011. 3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force and effect.
