<br />Trust and the lien created hereby shall not be destroyed or terminated by application of the <br />doctrine of merger and, in such event, Beneficiary shall continue to have and enjoy all of the <br />rights and privileges of Beneficiary under this Deed of Trust. In addition, upon foreclosure <br />under this Deed of Trust pursuant to the provisions hereof, any leases or subleases then existing <br />and affecting all or any portion of the Security shall not be destroyed or terminated by <br />application of the law of merger or as a matter of law or as a result of such foreclosure unless <br />Beneficiary or any purchaser at any such foreclosure shall so elect. No act by or on behalf of <br />Beneficiary or any such purchaser shall constitute a termination of any lease or sublease unless <br />Beneficiary or such purchaser shall give written notice of termination to such tenant or <br />subtenant. <br /> <br />8. Acceptance of Terms by Owner. By acceptance of this Deed of Trust, the Trustor <br />accepts and agrees to be bound by all of the covenants and restrictions included herein. <br /> <br />9. Governing Law. This Deed of Trust shall be governed by and construed in accordance <br />with the laws of the State of California. <br /> <br />10. Non-Discrimination. Trustor herein covenants by and for itself, its successors and <br />assigns, that there shall be no discrimination against or segregation of, any person or group of <br />persons on account of any basis listed in subdivision (a) or (d) of Section 12955 of the <br />Government Code, as those bases are defined in Sections 12926, 12926.1, subdivision (m) and <br />paragraph (1) of subdivision (p) of Section 12955, and Section 12955.2 of the Government Code, <br />in the sale, lease, sublease, transfer, use, occupancy, tenure, or enjoyment of the premises herein <br />conveyed, nor shall the grantee or any person claiming under or through him or her, establish or <br />permit any practice or practices of discrimination or segregation with reference to the selection, <br />location, number, use or occupancy of tenants, lessees, subtenants, sublessees, or vendees in the <br />premises herein conveyed. <br /> <br />IN WITNESS WHEREOF, Trustor has executed this Deed of Trust as of the date and year first <br />above written. <br /> <br />By: <br /> <br />City.HO.DOT <br /> <br />Page 14 of 15 <br /> <br />2/8/10 <br />
