Santa Ana River Channel <br />E01- R1551, R1553 <br />6. TERM (PMB2.1 N) <br />The term of this Lease shall be twenty (25) years, commencing on the Effective Date of this Lease. <br />7. TERMINATION (PMB3.1 N) <br />Either party may terminate this Lease at any time and for any reason, by giving the other, sixty (60) <br />days' advance written notice. <br />8. RENT (N) <br />The Premises shall be leased to TENANT on a rent -free basis. <br />9. CONSTRUCTION AND /OR ALTERATION BY TENANT (PMD2.1 N) <br />No buildings or permanent structures (other than recreational equipment and park benches), <br />improvements, facilities, antennas, above ground or underground utility lines or conduits, <br />communications lines, including telephone and cable lines are to be constructed, erected, altered, or <br />place on or within the Premises without prior written consent of Director. <br />All improvements constructed by TENANT within the Premises shall be constructed in strict compliance <br />with detailed plans and specifications approved by Director. <br />10. MECHANICS LIENS OR STOP - NOTICES (PMD4.1 S) <br />In addition to the responsibilities described in Clause 20 (Indemnification) below, TENANT shall at all <br />times indemnify, defend with counsel approved in writing by DISTRICT, and save DISTRICT and <br />County harmless from all claims, losses, demands, damages, costs, expenses, or liabilities arising from <br />mechanics liens or stop notices in connection with the use, construction, repair, alteration, or <br />installation of structures, improvements, equipment, or facilities by TENANT over, across, within, <br />upon, or under the Premises, and from the cost of defending against such claims, including attorney <br />fees and costs. <br />In the event a lien or stop - notice is imposed upon the Premises as a result of such construction, repair, <br />alteration, or installation, TENANT shall either: <br />A. Record a valid Release of Lien, or <br />B. Procure and record a bond in accordance with Section 3143 or 3196 of the Civil Code, which <br />frees the Premises from the claim of the lien or stop- notice and from any action brought to foreclose <br />the lien. <br />Should TENANT fail to accomplish one of the two actions above within fifteen (15) days after the file <br />of such a lien or stop- notice, this Lease shall be in default and shall be subject to immediate <br />Edna Park Lease (06.16.09) <br />
