Santa Ana River Channel <br />E01- R1551, R1553 <br />liability for labor or materials and excepting trade fixtures shall, at DISTRICT'S option, become the <br />property of DISTRICT at the expiration or sooner termination of this Lease. DISTRICT retains the <br />right to require TENANT, at TENANT'S cost, to remove any or all of TENANT'S improvements <br />located within, upon, under, or above the Premises at the expiration or termination hereof. TENANT <br />agrees that should DISTRICT require removal of said improvements, TENANT shall: (i) remove the <br />improvements, including any underground obstructions, at TENANT'S cost within sixty (60) days of <br />being notified by DISTRICT, (ii) leave the Premises in a level, safe, clean, sanitary and neat condition <br />free of weeds and debris; (iii) remove any underground obstructions, (iv) leave any excavated area <br />compacted to ninety percent (90 %) compaction, and (v) replace any erosion control landscaping that <br />may have been destroyed or removed as the result of any of the aforesaid activities. <br />14. UTILITIES (PME1.1 N) <br />TENANT shall construct, or cause to be constructed, all necessary utility facilities to be used by <br />TENANT within the Premises and shall be responsible for and pay, prior to the delinquency date, all <br />charges for utilities used by TENANT on the Premises. <br />Upon incorporation of Parcel R1553 to the leasehold premises, TENANT shall install a separate water <br />meter for this Parcel in TENANT'S name and account. <br />15. MAINTENANCE OBLIGATIONS OF TENANT (PME2.1 N) <br />TENANT agrees to maintain the Premises and all improvements constructed thereon in good order and <br />repair, and to keep said Premises in a neat, clean, orderly, safe, and sanitary condition to the <br />satisfaction of Director, and in compliance with all applicable laws. TENANT further agrees to <br />provide approved containers for trash and garbage and to keep the Premises free and clear of rubbish, <br />litter and waste to prevent the accumulation of any refuse.or waste materials which might constitute a <br />fire hazard or a public or private nuisance. <br />TENANT shall designate in writing to Director a representative who shall be responsible for the day - <br />to -day operation and level of maintenance, cleanliness, and general order. <br />Director shall have the right to enter upon and inspect the Premises anytime for cleanliness and safety. <br />If TENANT fails to maintain or make repairs or replacements as required herein, Director shall notify <br />TENANT in writing of said failure. Should TENANT fail to correct the situation within three days <br />after receipt of written notice, Director may make the necessary correction or cause it to be made and <br />_the cost thereof, including but not limited to the cost of labor, materials, equipment, and an <br />administrative fee equal to fifteen percent (15 %) of the sum of such items, shall be paid by TENANT <br />within 10 days of receipt of a statement of said cost from Director. Director may, at Director's option, <br />choose other remedies available herein, or by law. Failure of TENANT to properly maintain and repair <br />the Premises shall constitute a breach of the terms of this Lease. <br />Edna Park Lease (06.16.09) 5 <br />
