DEFINITIONS (PMA2.1 S) <br /> <br />The following words in this Lease have the significance attached to them in this clause, unless otherwise <br />apparent from context: <br /> <br />"Board of Supervisors" means the Board of Supervisors of the County of Orange acting as the governing <br />board of the Orange County Flood Control District. <br /> <br />"County" means the County of Orange, a political subdivision ofthe State of California <br /> <br />"Director" means the Director, OC Public Works, County of Orange, or designee. <br /> <br />"Flood Control Channel" means the Santa Ana River Channel and appurtenant structures located <br />adjacent to the easterly border of the leasehold premises. <br /> <br />2. PREMISES (PMA3.1 S) <br /> <br />Commencing with the Effective Date of this Lease, DISTRICT leases to TENANT that certain property <br />described in Exhibit A and shown on Exhibit B (hereinafter referred to as "Premises"), which Exhibits <br />are attached hereto and by reference made a part hereof. <br /> <br />3. LIMITATION OF THE LEASEHOLD (PMA5.1 S) <br /> <br />This Lease and the rights and privileges granted TENANT in and to the Premises are subject to all <br />covenants, conditions, restrictions, and exceptions of record, or apparent. Nothing contained in this Lease <br />or in any document related hereto shall be construed to imply the conveyance to TENANT of rights in the <br />Premises which exceed those owned by DISTRICT, or any representation or warranty, either express or <br />implied, relating to the nature or condition of the Premises or DISTRICT'S interest therein. TENANT <br />acknowledges that TENANT has conducted a complete and adequate investigation of the Premises and <br />that TENANT has accepted the Premises in its "as is" condition. <br /> <br />17"' Street Triangle Lease (07.01.09) <br /> <br />1 <br />
