'NORK MAY, OL tf C <br />AT►L �NSURA° C t :X THIRD EXERCISE OF OPTION A- 2009 -206 <br />-2, FOR TAXI LICENSE AGREEMENT <br />cLER S_ <br />'&TFTHIS THIRD EXERCISE OF OPTION, made and entered into this 18`b day of December, 2009, by and between <br />A White and Yellow Cab Company (hereinafter "Licensee ") and the City of Santa Ana, a charter city and municipal <br />corporation duly organized and existing under the Constitution and laws of the State of California ( "City"), <br />collectively referred to herein as "the Parties ". <br />� RECITALS <br />d <br />A. The Parties entered into that certain agreement entitled "Site License Agreement between the City of Santa <br />Ana and A White and Yellow Cab Company" dated December 19, 2005, hereinafter referred to as "said <br />Agreement ", to license commercial space at The Santa Ana Regional Transportation Center to A White and Yellow <br />Cab Company to be used to accommodate a taxi cab company to provide transportation to travelers, visitors and <br />0 <br />employees at The Santa Ana Regional Transportation Center. <br />B. The parties hereto now desire to exercise the third one -year option of said Agreement to extend the "Term" <br />_ (section 1.02) and to increase the "Compensation" term (section 1.03) of said Agreement. <br />U <br />WHEREFORE, in consideration of the mutual and respective covenants and promises hereinafter contained and <br />made, and subject to all of the terms and conditions of said Agreement as hereby amended, the parties hereto do <br />hereby agree as follows: <br />1. The "Term" section of said Agreement is hereby extended through December 18, 2010. <br />2. The "Compensation" section of said Agreement is hereby amended for the third option period and increased <br />to the monthly amount of $6,024.00. <br />3. Except as hereinabove modified, the terms and conditions of said Agreement, including the attached Rider, <br />remain unchanged and in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Third Exercise of Option of Taxi Cab License <br />Agreement the date and year first above written. <br />ATTEST: <br />Maria D.
