<br /> RESOLUTION 2010 <br /> PROPOSED <br /> REVENUE FY 09-10 FY 10-ll <br /> ACCOUNT DEPARTMENT/MISCELLANEOUS FEE OR SERVICE UNIT FEES FEES <br /> SECTION V FIRE DEPARTMENT <br /> SERVICE STATIONS <br /> 53502 Flat Fee 122.00 122.00 <br /> Additional Costs: <br /> Add up the quantities of all the various chemicals (or materials) in each of the three <br /> categories in each of the three categories (gallons, cubic feet, pounds). Use the highest <br /> quantity of chemicals (or materials) listed to determine the number range (1,2,3 <br /> Count the number of chemicals (or materials) listed to determine the appropriate range-letter (A, B, C...). <br /> Using the combined Range figures (Number and Letter, l-A, 2-C, etc. to determine the correct fee from the schedule). <br /> 53503 Late Filing Fee <br /> The Fire Chief shall impose a late filing penalty based on additional administrative <br /> costs incurred due to the late filing of any business plan, certification, or inventory. <br /> The amount of such penalty shall be 25% of the fee for such filing. Nonpayment <br /> of the fee and penalty shall incur 10% interest on the amount of the billing starting <br /> 30 days after the date issued. <br /> 53503 ADMINISTRATIVE PENALTY FEE SCHEDULE <br /> Administrative PenaltylCitationFee as indicated in the Health & Safety Code, as indicated in <br /> section 25514.5. These penalties are set in an escalating tiered manner. The Health & Safety <br /> Code "class II" violation is the Fire Department's "1st Administrative Citation." The "claass I" <br /> violation is the Fire Deparment's "2nd Adminsstrative Citation." Each penalty in either "class" is <br /> for each day the violation(s) occurs. The "new" fees are due to changes in the California Health <br /> & Safety Code. <br /> The citations listed below shall be issued for the following violations on a per day basis: <br /> 1. Failure to electronically submit annual certification by specified date. <br /> Class II Per day 0.00 2,000.00 <br /> Class I Per day 0.00 5,000.00 <br /> 2. H&S Code Section 25503.5 <br /> Failure to establish and or implement a Business Emergency Plan <br /> Class II Per day 392.50 2,000.00 <br /> Class I Per day 392.50 5,000.00 <br /> 3. H&S Code Section 25504 <br /> Failure to provide a complete Business Plan <br /> Class II Per day 235.75 2,000.00 <br /> Class I Per day 235.75 5,000.00 <br /> 4. H&S Section 25504a & 25509 <br /> Failure to complete annual inventory forms. <br /> Class II Per day 235.75 2,000.00 <br /> Class I Per day 235.75 5,000.00 <br /> 5.
