Developer and the Agency Executive Director. The Agency Executive Director is authorized to <br />initially approve the Schedule of Performance and make such revisions h deems reasonably <br />necessary, subject to concurrence of the Developer. <br />"Scope of Development" means the Scope of Development attached hereto <br />Attachment No. 5 and incorporated herein by reference, which describes the scope and quality of <br />development of the Developer finpr vements to be constructed by the Developer pursuant to .1 <br />terms and conditions f this Agreement. The Scope of Development is subject to revision from <br />time to time as mutually agreed upon in writing between the Developer and the Agency <br />Executive Director. The Agency Executive Director is authorized to make such revisions as lie <br />or she deems. reasonably necessary, subject to the concurrence of the Developer. <br />"Segiir• i Parcels " are shown on the Site Map and described in Attachment No. IA.. <br />"S g r,a rr chase gr# er rents" is defined in Recital E. <br />"Site" has the meaning set forth in Recital ltal . <br />"'Site Condition" is defined in Section 206.2. <br />"Site Impi- m#emeniN" means all existing, as of the date hereof, above-ground str UctUres <br />and underground basements, utility vaults and/or septic tanks, and any debris associated with <br />demolition of the foregoing, including without limitation such basements and/or septic tanks are <br />identified on Attachment No. 1. <br />"Site Map" means the neap which is attached hereto as Attachment No. I and <br />incorporated her in by reference. <br />"Brie Plan -Reiliew " means the fee unposed p rRlant tO City Council Resolution <br />No. 2009 -030, Section VIII, Revenue Account No. 5409, as amended from time to titre. <br />"So ils (ind Geologicid Corr on" means. the condition of the soil and its stability as it <br />relates to the devel pabilit of the Site. <br />" a.v, CreXtRegultdou Agreement" " shall mean the regulatory agrees ents which shall <br />be recorded against each Phase of the Rental Poili n of the Site r any portion thereof) with <br />respect to the issuance of Tax Credits. <br />'Mi.x C'r.e ts" shall rnean federal low income housing tax credits granted Pursuant to <br />Section 42 of the Internal Revenue Code and/or, if applicable, state tax credits pursuant <br />California Revenue and Taxation Code Sections 17057.5, 17058 23610.4 and 23610.5 and <br />California Health & Safety Code Sections 50193, et se q. <br />" CAC" means the California Tax Credit Allocation Com itte , the allocating agency <br />for Tax Credits its California. <br />"Thh-d Parly Costs" means Site Plan Review Fees and those amounts actually paid or <br />obligations incurred for work actually done by those consultants, co tr ct rs and advisors of the <br />DO C 1 400673N, 13/2002 72 i 1 <br />
