~NS;~~r~NC~ u~ <br /> WQR~t MAY ~~?~CE~C N-2010-046 <br /> LliVtlt IN~URAN~~ F~PlRES <br /> °2 ~ ~y- -p.~., CONSULTANT AGREEMENT BETWEEN THE <br /> DareK o~,,q~~ 201 CITY OF SANTA ANA AND CALIFORNIA <br /> C~ ~ ~qZ~,, ~ r RESIDENTIAL APPRAISERS <br /> <br /> ~af y ' vu~ THIS AGREEMENT, made and entered into this 1St day of June, 2010, by and between <br /> California Residential Appraisers, a Sole Proprietorship (hereinafter "Consultant"), and the City <br /> of Santa Ana, a charter city and municipal corporation duly organized and existing under the <br /> Constitution and laws of the state of California (hereinafter "City"). <br /> RECITALS <br /> A. Title III of Division B of the Housing and Economic Recovery Act of 2008 (Pub. L <br /> 110-289, 122 Stat. 2654 enacted July 30, 2009) makes available to certain qualified <br /> municipalities for certain qualified grant funds termed Neighborhood Stabilization <br /> Program under a program termed the Neighborhood Stabilization Program. <br /> B. The City desires to retain a consultant having special skill and knowledge in the field of <br /> real property acquisition and appraisal services for the Neighborhood Stabilization <br /> Program (NSP). <br /> C. Consultant represents that Consultant is able and willing to provide such services to the <br /> City. <br /> D. In undertaking the performance of this Agreement, Consultant represents that it is <br /> knowledgeable in its field and that any services performed by Consultant under this <br /> Agreement will be performed in compliance with such standards as may reasonably be <br /> expected from a professional consulting firm in the field. <br /> NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br /> terms and conditions hereinafter set forth, the parties agree as follows: <br /> 1. SCOPE OF SERVICES <br /> A. Consultant shall perform real property consulting and appraisal services for the NSP <br /> Homeownership Program at the following prices: <br /> "As-Is" Appraisal $400.00 <br /> ``Repaired Value" Appraisal $300.00 <br /> Updated "Repaired Value Appraisal $200.00 <br /> TOTAL : $900.00 maximum per property <br /> B. Appraisals for any other program (Downpayment Assistance Program or Rental <br /> Housing) shall be charged the Rates per the Consultant Fee Schedule attached hereto and <br /> incorporated herein as Exhibit A. <br /> C. Consultant must complete and attach a U.S. Department of Housing and Urban <br /> Development Certificate of Appraiser for each appraisal. See attached copy of form attached <br /> hereto and incorporated herein as Exhibit B. <br /> 1 <br /> <br />
