RESOLUTION NO. 2010-024 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA CERTIFYING THE FINAL ENVIRONMENTAL <br />IMPACT REPORT NO. 2006-02 PREPARED FOR THE <br />PROPOSED TRANSIT ZONING CODE (SD NO. 84) AND <br />THE PROPOSED REDEVELOPMENT OF PROPERTIES <br />OWNED BY THE SANTA ANA REDEVELOPMENT AGENCY <br />IN THE STATION DISTRICT, ADOPTING A MITIGATION <br />MONITORING AND REPORTING PROGRAM, AND <br />ADOPTING CEQA FINDINGS OF FACT AND A <br />STATEMENT OF OVERRIDING CONSIDERATIONS <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. In compliance with the California Environmental Quality Act (CEQA) <br />(Public Resources Code § 21000 et seq.) and Title XIV, California Code of <br />Regulations, Section 15000 et. seq. (CEQA Guidelines), the City of Santa <br />Ana has prepared an Environmental Impact Report (EIR) to analyze the <br />environmental impacts of the Transit Zoning Code (SD No. 84) and the <br />redevelopment of parcels owned by the Santa Ana Redevelopment <br />Agency (Agency) in the Station District, which would be developed with a <br />maximum of 220 residential units by the Agency and the Related <br />Companies of California, LLC and Griffin Realty Corporation, a California <br />Corporation (the Developer Project). <br />B. In compliance with CEQA and CEQA Guidelines Sections 15063 and <br />15082, the City prepared an Initial Study and Notice of Preparation (NOP) <br />of a Draft EIR, which was distributed to the Office of Planning and <br />Research, all responsible and trustee agencies, and other interested <br />parties on July 20, 2006. <br />C. The City held public scoping meetings on the Draft EIR on August 10, <br />2006 at the Santa Ana Regional Transportation Center. <br />D. In compliance with CEQA and CEQA Guidelines Section 15087, the City <br />provided public notice of the availability of the Draft EIR and sent a notice <br />of completion to the Office of Planning and Research on February 2, 2010, <br />which began a 45-day public review period. <br />E. Prior to the close of the public comment period and in response to <br />comments received during that period, the City amended Draft EIR to <br />evaluate three additional alternatives to the proposed Developer Project <br />and recirculated a portion of the EIR, including the analysis of all <br />alternatives (EIR, Chapter 5.0, Alternatives) and a financial analysis of the <br />Resolution No. 2010-024 <br />Page 1 of 130 <br />
