3. Adopt an ordinance approving amendments to various zoning <br />provisions of Santa Ana Municipal Code Chapter 41 (ZOA No. <br />2010-01). <br />4. Adopt an ordinance approving the creation of Specific Development <br />No. 84, approving the rezoning of properties from various zones to <br />Specific Development No. 84, repealing Specific Development No. <br />30, 37, 47 and 71 , and amending the height exemption areas map <br />(AA No. 2005-09). <br />5. Adopt a resolution approving Transit Zoning Code Architectural <br />Style Guidelines and Transit Zoning Code Street Network <br />Concepts. <br />M. The City Council of the City of Santa Ana held a duly noticed public <br />hearing on the above said actions on June 7, 2010, and at that time, <br />considered all testimony, written and oral, including all oral and written <br />testimony received at the May 27, 201 O Planning Commission Hearing. <br />N. At said public hearing, a Supplemental Staff Report dated June 7, 201 O from <br />the Executive Director of Planning and Building Agency to the City Manager <br />(the SSR) was presented to the City Council which contained the following: <br />1. Amendment to the General Plan Land Use Element as to Flood <br />Control. <br />2. Amendment to the TZC Street Network Concepts as to bus/transit <br />stops. <br />3. Supplemental Responses to Comments to the Draft EIR. <br />4. Amendments to the Findings of Fact <br />5. Additions to the Mitigation Monitoring and Reporting Plan. <br />The contents of the SSR were to be integrated into all of the applicable <br />referenced documents and be considered part of the record. <br />O. The City has prepared Findings of Fact in compliance with Public <br />Resources Code Sections 21081 and 21081.5 and CEQA Guidelines <br />Section 15091 for every significant impact of the Transit Zoning Code (SD <br />No. 84) and the Developer Project and for each alternative evaluated in <br />the EIR, including an explanation of the rationale for each finding. <br />P. The Transit Zoning Code (SD No. 84) and the Developer Project will have <br />significant impacts that cannot be mitigated to below the level of <br />significance. <br />O. The City has prepared a Statement of Overriding Considerations in <br />compliance with Public Resources Code Sections 21081 and CEQA <br />Guidelines Section 15093, which finds that specific economic, legal, <br />social, technological or other benefits of the Transit Zoning Code (SD No. <br />84) and the Developer Project outweigh the significant and unavoidable <br />impacts identified in the EIR. <br />Resolution No. 2010-024 <br />Page 3 of 130 <br />
