Iss7/08/10 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SANTA ANA AUTHORIZING THE <br /> EXECUTIVE DIRECTOR OF THE PUBLIC WORKS <br /> AGENCY TO SUBMIT GRANT APPLICATIONS TO <br /> THE DEPARTMENT OF RESOURCES RECYCLING <br /> AND RECOVERY FOR THE USED OIL PAYMENT <br /> PROGRAM <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA <br /> <br /> ANA AS FOLLOWS: <br /> Section 1. The City Council of the City of Santa Ana hereby finds, <br /> determines and declares as follows: <br /> A. Pursuant to Public Resources Code § 48690 the Department of <br /> Resources Recycling and Recovery (CalRecycle), formerly known <br /> as the California Integrated Waste Management Board, has <br /> established the Used Oil Payment Program (OPP) to make <br /> payments to qualifying jurisdictions for implementation of their used <br /> oil programs, including providing convenient collection locations, <br /> increasing demand for refined oil, motivation and education of the <br /> public to recycle used oil and developing research and <br /> demonstration projects; and <br /> B. In furtherance of this authority CalRecycle is required to establish <br /> procedures governing the administration of the OPP; and <br /> C. CalRecycle's procedures for administering the OPP require, among <br /> other things, an applicant's governing body to declare by resolution <br /> certain authorizations related to the administration of the OPP; and <br /> D. The City desires to apply for grant funds to continue its used oil <br /> collection program and to implement additional used oil recycling <br /> programs as they become feasible. <br /> Section 2. The City Council hereby authorizes the submittal of a Used <br /> Oil Payment Program application to CalRecycle for all available grants under the <br /> OPP for a period of five years, extending through June 30, 2015. <br /> Section 3. The Council appoints and authorizes the Executive Director <br /> of the Public Works Agency, or his designee, as agent of the City of Santa Ana to <br /> conduct all negotiations, execute and submit all documents, including but not <br /> limited to applications, agreements, amendments, and annual reports including <br /> 55A-3 <br /> <br />
