JUL i 9 2ofD O: PRCS (�. ) Donna Schultze SECOND AMENDMENT TO RECREATION SERVICES AGREEMENT N- 2007 -143 -02 THIS SECOND AMENDMENT TO RECREATION SERVICES AGREEMENT is made and entered into this 1st day of December, 2009 by and between Body By Boot Camp, a partnership (hereinafter "Provider "), and [he City of Santa Ana, a charter city and municipal corporation of the State of California ( "City "). RECITALS: The parties entered into Agreement N- 2007 -143, dated November 6, 2007, as amended on December 12, 2008 (hereinafter "said Agreement ") by which Provider has conducted body Ftness and conditioning classes in the City's leisure program. In accordance with the terms and conditions of said Agreement, the parties wish to amend the Scope of Services and renew said Agreement for an additional one -year period. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this Second Amendment to Recreation Services Agreement, [he parties agree as follows: I . Section I, SCOPE OF SERVICES, shall be deleted in its entirety and replaced with the following: "Provider shall provide instruction for the City's leisure class program as set forth in Exhibit A -I, attached to this Second Amendment to Agreement." 2. Section 3, TERM, shall be amended to extend the termination date from December 31, 2009 to December 3 1, 201 O. 3. Except as herein amended, all terms and conditions of said Agreement shall remain in full force and effect.
