.... ........
MEMORANDUM
a i _ o A: Edward -T—C-noper.
[."
.-sent W -. - --
Stibj - - - I - - - -
-- -
In response to your memo of September 25, 1985, we are
providing you with excerpts from McQuillan, Muniei al Corpo-
rations,
or -
rations, as it relates to record keeping.
Charter Section 702 requires you to keep an "accurate
journal of council roceed i res" and requires the recording
of votes in any final action,
As stated in McQuillan, § 14.03, the record need not
reflect informal discussions or offhand conversations.
The purpose of the 12:00 to 3:00 p.m. session is to
engage in informal discussion where action is not to be taken,
If you are directed by the Council to simply record the topics
being informally discussed, then you have fulfilled your
charter duties. I, by chance, a vote is taken during the
informal discussions, then your journal should reflect the
vote on the issue, If such a record is not kept of the votes,
then the record would be insufficient as to that action and
it would probably not be binding.
Please advise if we may answer further questions.
WiaCoop r
City
EJC: ad
cc: Mayor & Councilme hers
Robert Bob
