Fletcher, City Attorney <br />Date: July 31, 2000 <br />Re: Prohibition of Larry Means serving as Hearing Officer <br />cc: City Manager, Assistant City Manager, Acting Planning Director, <br />Chief Assistant City Attorney <br />At its last meeting, the City Council requested that Ken Adams explore the feasibility of <br />permitting Mr. Larry Means, a principal in the mediation services firm of Keystone Enterprises, <br />to "bid" or otherwise compete for City hearing-officer services in the Planning & Building <br />Services Agency. The City currently exclusively contracts with Abel Armas for such services. <br />Mr. Means currently serves as the Chairman of the City's Personnel Board. Mr. Adams <br />contacted my Office regarding the preparation of an agreement with Keystone Enterprises. In <br />the process of reviewing the matter, I noted the attached Section 911 from the City's Charter. <br />particularly address your attention to the final phrase of Section 911 which provides: <br />"None of the members shall ... while a member of the <br />personnel board or for a period of one (1) year after he <br />has ceased for any reason to be a member, be eligible for <br />THIS DOCUMENT IS CONFIDENTIAL AND SUBJECT TO THE ATTORNEY CLIENT AND/OR <br />ATTORNEY WORK PRODUCT PRIVILEGES. <br />DISCLOSURE OF THIS DOCUMENT OR THE CONTENTS THEREOF MAY BE A VIOLATION OF <br />LAW. <br />
