Opinion No. 73-51 <br />square, park or other public use, or the disposal of, <br />closing or abandonment of any public property, or the <br />construction or authorization of any public building, <br />in the area to which that portion of the master plan <br />applies, its location, purpose and extent shall first <br />be submitted to, reviewed, and reported upon by the <br />Planning Commission as to compliance with that portion <br />of the adopted master plan." <br />On July 23, 1973, at its regular scheduled meeting, the <br />Planning Commission was briefed on the proposed Thornton Park <br />Site Exchange Agreement with the William F. Lyon Company. At <br />its regular meeting scheduled for August 13, 1973, the Planning <br />Commission will, pursuant to the direction by the Santa Ana City <br />Council, consider the effect of the Thornton Park Site Exchange <br />Agreement upon the adopted master plan of the City. <br />The Commission has two alternatives: <br />1. If it is found by the Commission that the Agreement <br />is in conformity with the adopted master plan, the Commission <br />may merely transmit these findings to the City Council. The <br />Council may then proceed to ratify the Agreement and no amendment <br />of the general plan will be required. <br />2. If it is found by the Commission that the Agreement <br />is not in conformity with the adopted master plan, the Commission <br />should transmit those findings to the Council. The Council may <br />immediately ratify the Agreement with the condition that escrow <br />shall not close until the requisite public hearings are held for <br />the amendment to the general plan by the Planning Commission and <br />the City Council. <br />James thers, Cit torney <br />By Charles J. ibe to, Assistant <br />City A orney <br />101 <br />
