ARRA EXHIBIT D <br />(Standard Agreement) <br />C. If the head of a Federal department or agency determines that it is necessary to waive the <br />application of subsection A. based on a finding under subsection B., the head of the department or <br />agency shall publish in the Federal Register a detailed written justification as to why the provision <br />is being waived. <br />D. This section shall be applied in a manner consistent with United States obligations under <br />international agreements. <br />E. Implementation of this provision should follow the forthcoming requirements in the Federal <br />Acquisition Regulation or as otherwise identified by the Contracting Officer. <br />6. PROCUREMENT <br />All funds under this Agreement expended through a subcontract for personal services or goods shall be <br />fully subject to open and free competition as directed by OMB Circulars A-102 and A-110. Contractor <br />may not procure any goods and services in excess of $500 (except for the specific personnel costs identified <br />in this Agreement. <br />INFORMATION IN SUPPORT OF RECOVERY ACT REPORTING <br />Subcontractor is responsible to maintain and may be required to submit backup documentation for all <br />expenditures of funds under the Recovery Act including such items as timecards and invoices. <br />Subcontractor shall provide copies of backup documentation at the request of the CAPOC or designee. <br />ARRA-D2
