8. The client for whom the Insured performs Covered Operations, provided that a <br />written contract or written agreement is in effect between the Named Insured and <br />the client requiring the client to be an Additional Insured for Covered Operations <br />which result in a Pollution Condition and the Bodily Injury, Property Damage <br />or Environmental Damage occurs on or after the execution of such contract or <br />agreement. Such client is only an Additional Insured with respect to liability for a <br />Pollution Condition arising out of Covered Operations performed by another <br />Insured. The Company's liability shall only be for the lesser of the Limits of <br />Liability required by such written contract or written agreement or the remaining <br />Limits of Liability under this Policy. <br />Section III. EXCLUSIONS, Subsection G. does not apply to a Claim by the client <br />against another Insured for a Pollution Condition for which coverage is provided <br />under this Endorsement. <br />N. Potential Claim means the performance of Covered Operations which may reasonably <br />be expected to give rise to a Claim. <br />Solely with respect to coverage afforded pursuant to this Endorsement, Section IV. DEFINITIONS, <br />is amended to include the following definitions: <br />AA. Clean-up Costs means expenses incurred in the removal or remediation of soil, surface <br />water, groundwater, or other contamination resulting from Pollution Conditions, <br />provided such expenses: <br />1. Are specifically mandated by any governmental entity duly acting under the <br />authority of environmental law(s); or <br />2. Have been incurred by a governmental entity or by a third party. <br />BB. Client means a natural person or entity to whom the Insured renders general construction <br />activity pursuant to a written contract. <br />CC. Covered Operations means those physical construction operations and activities <br />performed for others by the Insured or any entity for whom the Insured is legally liable. <br />DD. Environmental Damage means physical damage to soil, surface water or groundwater, or <br />plant or animal life, caused by Pollution Conditions and giving rise to Clean-up Costs. <br />EE. Insured Contract means that part of any contract or agreement pertaining to Covered <br />Operations (including an indemnification of a municipality in connection with work <br />performed for a municipality) under which the Named Insured assumes the tort liability <br />of another party to pay for Bodily Injury, Property Damage or Environmental Damage <br />to a third person or organization. Tort liability means a liability that would be imposed by <br />law in the absence of any contract or agreement. <br />FF. Insured's Products means goods, products or equipment, including component parts <br />thereof, and including other products in which goods, products or equipment are <br />AE 00056 00 (01/21) <br />
