10. screening, selection, recruitment or placement of candidates for temporary or permanent <br /> employment by others as information technology professionals; <br /> 11. telecommunication services; <br /> 12. telecommunication products; and <br /> 13. web related software and connectivity services performed for others. <br /> • telecommunication products means computer hardware, firmware and/or software products, <br /> electronic equipment or devices manufactured, sold, handled, distributed or disposed of by you which <br /> are specifically designed or intended for use in telecommunication systems or your <br /> telecommunication services. <br /> • telecommunication services means the following services performed for others: <br /> 1. telephone services including competitive access provider, dial tone access, digital subscriber line <br /> (DSL), incumbent/local exchange carrier, facsimile, integrated services digital network (ISDN), <br /> interconnection, local, long distance, reseller, switching, and 911 emergency services; <br /> 2. means call conferencing, call forwarding, call identification, call return, call waiting, calling card, <br /> directory assistance, repeat dialing, speed dial, toll free, video conferencing, voice messaging <br /> services; <br /> 3. cellular and wireless communication services including paging and ground based satellite <br /> communication services; <br /> 4. provision of cable television services; and <br /> 5. telecommunication consulting services. <br /> • temporary worker means a person who is provided to you by a third party for a specific time period <br /> to support or increase your work force in special situations. Such situations may include employee <br /> absences, temporary skill shortages and seasonal workloads. A temporary worker is not an employee <br /> of yours. <br /> • third party corporate confidential information means third party corporate information provided to <br /> you and protected under a nondisclosure agreement or confidentiality provision of a contract entered <br /> into by the named insured with the owner of the third party corporate information. <br /> • third party service provider means an independent contractor operating on behalf of the named <br /> insured pursuant to a written contract or agreement with the named insured but only if such <br /> independent contractor is acting within the scope of the terms of the written contract or agreement for <br /> the benefit of the named insured. <br /> • wrongful act means the following: <br /> 1. data privacy wrongful act; <br /> 2. network wrongful act; <br /> 3. professional services wrongful act; and <br /> 4. security wrongful act. <br /> Wrongful act also includes an interrelated wrongful act. Wrongful act includes any of the <br /> foregoing when caused by the acts of a rogue employee. <br /> • you or your mean, individually and collectively: <br /> 1. any named insured; <br /> 2. any past or present partner, executive officer, or any individual in an equivalent position of a <br /> named insured, including but not limited to individuals that hold management positions similar to <br /> an executive officer for any named insured that does not have a charter, constitution, by-laws <br /> or any other similar governing document, but only while performing their duties as such; <br /> 3. any past or present employee of the named insured but only while performing their duties as <br /> such; employee does not include a temporary worker; <br /> 4. any individual person who is an agent or independent contractor but only while acting within the <br /> scope of his or her contract worker agreement with the named insured; <br /> FS 00 0003 00 1016 FailSafe GIGA° Release 4.0 Page 11 of 20 <br /> 2-50002 ©2016, The Hartford <br />
