<br />Section 2 ‒ Federal Changes and Initiatives | 2024 <br />Equipment <br />Maintenance <br />and Sustainment <br />Use of EMPG funds for maintenance contracts, warranties, <br />repair or replacement costs, upgrades, and user fees are <br />allowable as described in FEMA Ibs 336 and 379, as well as <br />Grant Programs Directorate Policy FP 205-402-125-1. <br />Small <br />Unmanned <br />Aircraft Systems <br />All requests to purchase Small Unmanned Aircraft Systems <br />(SUAS) with FEMA grant funding must comply with FEMA <br />Policy 207-22-0002 and include copies of the policies and <br />procedures in place to safeguard individuals’ privacy, civil <br />rights, and civil liberties of the jurisdiction that will purchase, <br />take title to, or otherwise use the SUAS equipment. <br />Reference the Presidential Memorandum: Promoting <br />Economic Competitiveness While Safeguarding Privacy, Civil <br />Rights, and Civil Liberties in Domestic Use of Unmanned <br />Aircraft Systems for additional information. All SUAS purchase <br />requires FEMA approval prior to making purchase. <br />Telecommuni- <br />cations Equipment <br />or Services <br />Effective August 13, 2020, section 889(f)(2)-(3) of the <br />John S. McCain National Defense Authorization Act <br />for FY 2019 (NDAA), Pub. L. No. 115-232 (2018) and <br />2 C.F.R. § 200.216, 200.471, and Appendix II to 2 C.F.R. <br />Part 200 prohibits DHS/FEMA Recipients and Subrecipients <br />(including their contractors and subcontractors) from using <br />any FEMA funds under open or new awards for the following <br />covered telecommunications equipment or services: <br />Prohibitions <br />1) Telecommunications equipment produced by Huawei <br />Technologies Company or ZTE Corporation, (or any subsidiary <br />or affiliate of such entities); <br />2) For the purpose of public safety, security of government <br />facilities, physical security surveillance of critical infrastructure, <br />and other national security purposes, video surveillance and <br />telecommunications equipment produced by Hytera <br />Communications Corporation, Hangzhou Hikvision Digital <br />Technology Company, or Dahua Technology Company <br />(or any subsidiary or affiliate of such entities); <br />3) Telecommunications or video surveillance services provided <br />by such entities or using such equipment; or <br />4) Telecommunications or video surveillance equipment or <br />services produced or provided by an entity that the Secretary <br />of Defense, in consultation with the Director of National <br />Intelligence or the Director of the Federal Bureau of <br />Investigation, reasonably believes to be an entity owned or <br />9
