<br />Section 2 ‒ Federal Changes and Initiatives | 2024 <br />Prohibited and <br />Controlled <br />Equipment Cont. <br />For all awards issued on or after January 1, 2023, The policy <br />directly prohibits certain types of equipment outright <br />(prohibited equipment), whereas other types of equipment <br />may be controlled, or LEAs are required to submit <br />certifications prior to purchase. <br />Even if equipment is listed as controlled equipment and is <br />not outright prohibited, that does not automatically make it <br />allowable under a particular FEMA program. Recipients and <br />subrecipients should refer to applicable program guidance <br />or contact your Grants Analyst to determine if a particular <br />type of equipment is allowable under that program. <br />Additional information regarding Prohibited and Controlled <br />Equipment is available on FEMA Policy 207-22-0002. <br />Build America, <br />Buy America Act <br />(BABAA) <br />Under FEMA financial assistance programs, the BABAA <br />requirements apply to: <br />• New awards made on or after January 2, 2023, <br />• New funding that FEMA obligates to existing awards or <br />through renewal awards on or after January 2, 2023; and <br />• Infrastructure projects. <br />Funds provided under this program may not be used for a <br />project for infrastructure unless the iron and steel, <br />manufactured products, and construction materials used in <br />that infrastructure are produced in the United States. <br />The Buy America preference only applies to articles, <br />materials, and supplies that are consumed in, incorporated <br />into, or affixed to an infrastructure project. As such, it does <br />not apply to tools, equipment, and supplies, such as <br />temporary scaffolding, brought to the construction site and <br />removed at or before the completion of the infrastructure <br />project. Additionally, the Buy America preference does not <br />apply to equipment and furnishings, such as movable chairs, <br />desks, and portable computer equipment, that are used at <br />or within the finished infrastructure project but are not an <br />integral part of the structure or permanently affixed to the <br />infrastructure project. <br />11
