CITY OF SANTA ANA ATTACHMENT D NON -COLL US ION AFF IDAVIT (Title 23 United States Code Section 112 and Publ ic Contract Code Section 7106) To the CITY OF SANTA ANA In accordance with Title 23 United States Code Section 112 and Pub lic Contract Code 7106 the proposer decl ares that the proposa l is not made in th e in t erest of, or on beha lf of, any undisclosed person , partnership, company , association , organization , or corporation; that the proposal is genuin e and not co llu sive or sham; that the proposer has not directly or indirectly induced or so licited any other proposer to put in a fa lse or sham proposa l, and has not directly or indirectl y co llud ed, conspired, con ni ved or agreed with any proposer or anyone else to put in a sham proposa l, or that anyone sha ll refra in from bidding ; that the proposer has not in any manner, directly or indirectl y, sought by agreement, commun ication , or co nference with anyone to fix the proposa l pri ce of the propo ser or any proposer, or to fix any overhead , profit, or cost element of the proposal price , or of that of any other proposer, or to sec ure any advantage against the public body awarding the contract of anyone interested in the proposed contract; that all statements contained in the proposal are true ; and, further, that the proposer has not, d irectl y or indirectly , subm itted his or her proposa l price or any breakdown thereof, or the contents th ereof, or divulged inform ation or data re lative thereto , or paid , and will not pay, any fee to any corporation , partnership , company association . organization , bid depository, or to any member or agent thereof to effectuate a collusive or sl1am proposa l.
