Administrative Plan 7/1/2025 <br /> <br />Page 3-27 <br />Previous Behavior in Assisted Housing [24 CFR 982.552(c)] <br />HUD authorizes the PHA to deny assistance based on the family’s previous behavior in assisted <br />housing. <br />PHAs are not permitted to deny assistance to a family because the family previously failed to <br />meet its obligations under the Family Self-Sufficiency (FSS) program [24 CFR 984.101(d)]. <br />SAHA Policy <br />SAHA will deny assistance to an applicant family if: <br />The family does not provide information that SAHA or HUD determines is <br />necessary in the administration of the program. <br />The family does not provide complete and true information to SAHA. <br />Any family member has been evicted from federally assisted housing in the last <br />three years. <br />Any family member has committed fraud, bribery, or any other corrupt or <br />criminal act in connection with any federal housing program. <br />The family owes rent or other amounts to any PHA in connection with Section 8 <br />or other public housing assistance under the 1937 Act, unless the family repays <br />the full amount of the debt prior to being selected from the waiting list. <br />(This policy does not apply to the Veterans Supportive Housing program.) <br />If the family has not reimbursed any PHA for amounts the PHA paid to an owner <br />under a HAP contract for rent, damages to the unit, or other amounts owed by the <br />family under the lease, unless the family repays the full amount of the debt prior <br />to being selected from the waiting list. <br />The family has breached the terms of a repayment agreement entered into with <br />SAHA, unless the family repays the full amount of the debt covered in the <br />repayment agreement prior to being selected from the waiting list. <br />When denying admission due to family debts as shown in HUD’s EIV <br />system, SAHA will provide the family with a copy of the EIV Debt Owed <br />to PHA and Termination report. <br />If the family wishes to dispute the information in the report, the family <br />must contact the PHA that entered the information in EIV in writing, <br />explaining why EIV information is disputed. The family must also provide <br />a copy of the letter and all applicable verification to the PHA to support <br />the family’s claim. SAHA will consider the information provided by the <br />family prior to issuing a notice of denial. <br />A family member has engaged in or threatened violent or abusive behavior toward <br />PHA personnel. <br />Abusive or violent behavior towards PHA personnel includes verbal as <br />well as physical abuse or violence.
