(11) Voluntary Compliance Agreement. The Executive Director of the Planning and <br /> Building Agency, or designee, is hereby authorized to enter into a Voluntary <br /> Compliance Agreement with a business owner or property owner in order to <br /> establish terms for compliance with the provisions of this Article." <br /> Section 6. Section 41-2004 (The Industrial Overlay (I-OZ) Zone) of Chapter 41 <br /> of the SAMC is hereby amended to read as follows: <br /> "Sec. 41-2004 Reserved." <br /> Section 7. Section 41-2005 (Application for Discretionary Approvals) of Chapter <br /> 41 of the Santa Ana Municipal Code is hereby amended to read as follows: <br /> "Sec. 41-2005. Application for Discretionary Approvals <br /> (a) Site Plan Review shall mean specific development plan and shall comply with <br /> Sections 41-593.4 through 41-593.6. Sections 41-593.4 through 41-593.6 shall <br /> only apply to structures over four (4) stories in height. <br /> (b) Conditional use permits, variances and minor exceptions. Conditional use permits, <br /> variances and minor exceptions shall be subject to Article V of this Chapter, except <br /> for the permit thresholds for minor exceptions shall be as identified in Table 1 B of <br /> this Article. <br /> (c) Effect of amendments to this Article on applications in progress shall apply as <br /> follows: <br /> (1) Discretionary Applications Submitted and Determined Complete. All <br /> discretionary permit applications that are active and that have been determined <br /> to be complete before the effective date of the Article or any amendment, shall <br /> be processed in compliance with the requirements in effect when the <br /> application was deemed complete, and pursuant to all requirements of Section <br /> 41-2008. <br /> (2) Approved Projects Not Yet Under Construction. Any structure authorized by a <br /> discretionary permit or approval of a land use as allowed by this Article for <br /> which a Building Permit application has been submitted or a Building Permit <br /> has been issued may be constructed in compliance with the permit or approval, <br /> as long as construction is completed and the approved land use is established <br /> before the expiration of the permit or, where applicable, before the expiration <br /> of any approved time extension. <br /> (3) Project Under Construction.
