The CONTRACTO R w ill pay , and wi ll require a ll subco ntractors to pay, a ll employees on the WORK <br />OF IMPROVEMENT a sa lary or wage at least eq ua l to the preva ili ng sa lary or wage established for <br />s uch wo rk as se t fo rth in th e wage determinat ions for th is work in accordance w ith app li cable State <br />a nd Federal law. <br />6. If app li cab le, the CONTRACTOR shall adhere to the CITY 'S Commun ity Workforce Agreement <br />(CW A), a pre-hire co ll ect ive bargaining agreemen t, which estab lishes the labor re lations policies and <br />procedures for CONTRACTOR to fo ll ow in the crafts persons emp loyed to complete the WORK OF <br />IMPROVEMENT as more full y described in th e CWA. CONTRACTOR sha ll. after award of thi s Contract , furnish two bonds to be approved by th e CITY, <br />o ne in th e amount of One Hundred Percent ( I 00%) of the Contract pric e, to guarantee the fait hfu l <br />performance of the work (Performanc e Bond), and one in the amoun t of One Hundr ed Percent (10 0%) <br />of the Contrac t price to guarantee payment of all c la ims for labor and mater ials furnished (Payment <br />Bond). This Contract shall not become effective until such bonds are supplied to and approved by the <br />CITY. <br />8. CONTRACTOR sha ll , pri or to the release o f the pe rfo rman ce and payment bonds or the rete nti on <br />payment , furni sh a warra nty perfor mance and payment bond (War ranty Bo nd ). Sa id Warranty Bond <br />shall also be required as a condition of project acce pt ance. For proje cts up to Five Hundred Thousand <br />Do llars ($500,000), the Warranty Bond amount sha ll be the greater of Ten Thousand Do ll ars ($10,000) <br />or Twenty Percent (20%) of the fina l contra ct pri ce. For projects above Five Hundred Thousand <br />Dollars ($500,000), the Warranty Bond amou nt sha ll be th e grea ter of One Hundred Thousand Dollars <br />($100 ,000) or Ten Percent ( I 0%) of the fina l contract price. <br />9. CONTRACTO R sha ll , after award of this Contract, furnish Certificates of Liability Insurance and <br />Worker's Compensation In surance as out lin ed in th e General Provisions , to be approved by the C IT Y. <br />10.
