Information Bulletin 2024-DLE-13 <br /> Guidance re:AB 481 <br /> Page 4 <br /> (LRAD) (Gov. Code, § 7070, subd. (c)(13)); <br /> 14. the following projectile launch platforms and their associated munitions: 40mm projectile <br /> launchers, "bean bag," rubber bullet, and specialty impact munition (SIM) weapons (Gov. Code, <br /> § 7070, subd. (c)(14)); and <br /> 15. any other equipment as determined by a governing body or a state agency to require additional <br /> oversight. (Gov. Code, § 7070, subd. (c)(15).) <br /> Notwithstanding paragraphs (1) through (15), "military equipment" does not include general <br /> equipment not designated as prohibited or controlled by the federal Defense Logistics Agency. (Gov. <br /> Code, § 7070, subd. (c)(16).) <br /> III. Requirements That Apply to Both LEAS and State Agencies <br /> LEAS and state agencies are each required to draft and post on the agency's internet website a <br /> "military equipment use policy," which is a written document governing the use of"military <br /> equipment" as defined in AB 481 (Gov. Code § 7070, subd. (d)); Gov. Code §§ 7071, subd. (b), (d)(2); <br /> 7072, subd. (a); 7073, subd. (c)(1).) <br /> The "military equipment" use policy of LEAS and state agencies shall address, at a minimum, all of the <br /> following: <br /> 1. a description of each type' of"military equipment;" <br /> 2. the quantity of"military equipment" sought; <br /> 3. the capabilities of each type of"military equipment;" <br /> 4. the expected lifespan of the "military equipment;" <br /> 5. product descriptions from the manufacturer of the "military equipment;" <br /> 6. the purposes and authorized uses for which the LEA or the state agency proposes to use each <br /> type of"military equipment;" <br /> 7. the fiscal impact of each type of"military equipment," including: <br /> a. the initial costs of obtaining the "military equipment," and <br /> b. estimated annual costs of maintaining the "military equipment;" <br /> 8. the legal and procedural rules that govern each authorized use; <br /> 9. the training, including any course required by the Commission on Peace Officer Standards and <br /> Training, that must be completed before any officer, agent, or employee of the LEA or the state <br /> agency is allowed to use each specific type of"military equipment" to ensure the full protection <br /> of the public's welfare, safety, civil rights, and civil liberties and full adherence to the "military <br /> equipment" use policy; <br /> ' Under Gov. Code, § 7070, subd. (f), references to "type" of military equipment means each item that shares <br /> the same manufacturer model number. <br />
