<br /> <br />January 2025 7 Environmental Analysis <br />Code Section <br />Title Existing Zoning Code Regulations Proposed Zoning Code Regulations <br />noxious uses through amortization. <br />• Elimination of certain nonconforming <br />uses and structures <br />• Establishes a process for enacting <br />amortization periods for eliminating <br />certain nonconforming uses. <br />• References to SAMC and State law <br />for abatement of public nuisances. <br />• Establishes authority for voluntary <br />compliance agreements between the <br />City and nonconforming uses. <br />The Industrial <br />Overlay (I-OZ) <br />Zone <br />SAMC Section 41-2004 establishes an <br />overlay zone applied to M1 and M2 zoned <br />properties located within the TZC boundary. <br />Section 41-2004 is deleted in its <br />entirety, removing the I-OZ Zone from <br />the TZC to eliminate industrial land use <br />type zoning altogether. <br />Application for <br />Discretionary <br />Approvals <br />SAMC Section 41-2005 establishes the <br />process and timing of vesting for certain <br />uses approved with a discretionary permit. <br />Section 41-2005 is renumbered as 41- <br />2004, and the update to the text of this <br />Section adds clarification for effects of <br />the amendments to the TZC dependent <br />upon status of an application in the City <br />process of review, approval, and/or <br />building permit issuance, if required. <br />Zones <br />Established <br />SAMC Section 41-2006 contains the <br />regulations for zoning districts, land uses, <br />and permit types within the TZC. <br />The update to the text of this Section <br />deletes the I-OZ Zone, including <br />replacing Figure 2.1, the Regulating <br />Plan (map) with a new Figure 2.1 <br />removing the I-OZ Zone designation <br />from all parcels within the TZC <br />boundary. <br />Uses <br />Permitted <br />SAMC Section 41-2007 provides the <br />allowable land uses and permit types <br />required to establish a land use by each <br />zoning district within the TZC. <br />The update to the text of this Section <br />clarifies application of the use <br />standards by zoning district as follows: <br />• Modifies Table 2A containing the Use <br />Standards by adding and reclassifying <br />certain land use types appropriate to <br />the TZC land use subcategories <br />• Deletes certain land use types that are <br />inconsistent with the intent and purpose <br />of the TZC, including the deletion of the <br />Small-Scale Industry land use <br />subcategory in its entirety. <br />Operational <br />Standards <br />SAMC Section 41-2008 primarily regulates <br />new uses within the TZC. <br />The update to the text of this Section <br />further limits certain operations to <br />ensure greater compatibility between <br />residential and non-residential land <br />uses. <br />Operational <br />Standards for <br />Nonconforming <br />Industrial Uses <br />SAMC Section 41-2009 is an entirely new <br />set of regulations specific to existing <br />nonconforming industrial uses within the <br />TZC. <br />The new Section establishes <br />regulations for operation of any existing, <br />legally established, nonconforming <br />industrial use.
