Additionally, the HRA portion of the assessment analyzed cancer risk <br />for residents and employees in the neighboring vicinity over nine-year, 25-year, 30-year, <br />and 70-year time periods, illustrating that the construction and operations of the new service <br />station is significantly lower than the threshold of exposure. Moreover, the assessment <br />prepared illustrated that the highest maximum chronic hazard indices for resident and <br />employees are well-under the regional significant threshold, meaning the non-cancer <br />impacts on the neighboring vicinity are not likely to impact the nearby residents and <br />employees. <br />Noise and Vibration Impact Assessment <br />The Noise and Vibration Impact Assessment (Exhibit 9) examined noise levels during <br />construction and after the project's completion. The assessment found that the noise <br />generated from demolition, site preparation, grading, building construction, and paving <br />would remain within the limits of the Construction Noise Standard. Additionally, to adhere to <br />the City’s Noise Control Ordinance (Santa Ana Municipal Code Sections 18-308 through 18- <br />321), construction will be restricted to hours between 7:00 a.m. and 8:00 p.m. on weekdays, <br />weekends, and federal holidays. Lastly, the anticipated noise levels from the project’s <br />operation are expected to have minimal impact and not significantly increase. <br />The applicant’s request for a CUP to allow a new service station will provide an added amenity <br />to the property, for the employees who work in the vicinity, and for the residents who live in the <br />general area. In addition, the proposed service station and commercial units will generate new <br />and permanent employment opportunities and support the economic growth and stability of <br />the City, activate the street and generate property and sales tax revenue. To ensure that the <br />service station operations are not detrimental to the health, safety, or general welfare, staff is <br />recommending conditions of approval that would help ensure that the operations would not <br />generate noise impacts or that would help reduce the impacts to negligible conditions. These <br />conditions of approval include ensuring that the project complies with the City’s Noise <br />Ordinance at all times. <br />Variance No. 2025-01 (Reduction in Required Setback) <br />Similar to CUPs, variance requests are governed by Section 41-638 of the SAMC. Variances <br />may be granted when it can be shown that because of special circumstances applicable to the <br />subject property, including size, shape, topography, location or surroundings, the strict <br />application of the zoning ordinance is found to deprive the subject property of privileges <br />enjoyed by other properties in the vicinity and under identical zone classification. Additionally, <br />the granting of the variance cannot be detrimental to the public welfare or injurious to the <br />surrounding area, adversely affect the General Plan, and must be necessary for the <br />preservation and enjoyment of one or more substantial property rights.
