46 <br />6. One copy will be returned to the contractor approved or disapproved within <br />thirty (30) calendar days of receipt. <br />7. If the request for approval of an equipment purchase is disapproved, the <br />contractor may appeal the decision in accordance with Section II, paragraph <br />P, Resolution of Contract Administration Disputes. <br />8. Procurement practices must also be in accordance with the following <br />provisions: <br />a. Public Agencies shall comply with the applicable sections of the PCC. <br />b. Lease-purchase agreements are subject to the above requirements. <br />c. If the work is to be performed through a subcontract, the requirements of <br />the Section V, Subcontracts, above apply. <br />d. When private agencies submit proposed subcontracts for renovation and <br />repair for approval, evidence shall be included that the proposed <br />subcontractor has obtained a payment bond in an amount not less than <br />one-half (1/2) the amount of the proposed subcontract. <br />F. Obtaining Bids for Equipment Purchases, Leases, Replacements, and <br />Improvements for Private Agencies (2 CFR 200 and 5CCR 18040) <br />1. All equipment purchases, replacements, and improvements not performed by <br />the contractor’s staff exceeding five thousand dollars ($5,000), including tax, <br />must have at least three (3) bids or estimates. <br />a. Each bid or estimate must contain prices for equivalent and comparable <br />items and/or services. <br />b. When available, consolidating procurements to obtain a more economical <br />purchase is required. <br />c. Subdividing equipment purchases into separate items to avoid the <br />competitive bidding requirement is prohibited. <br />i. If bids or estimates are required, the contractor shall purchase the <br />goods or services from the lowest responsible bidder or estimator. The <br />contractor shall conform to the materials, terms and conditions of the <br />invitation for bid, and with paragraph E, Preapproval Requirements, <br />above.
