5 LESS -THAN -SIGNIFICANT ENVIRONMENTAL EFFECTS <br />WITH MITIGATION INCORPORATED <br />• Surround stationary equipment with noise barriers or utilize a temporary noise <br />barrier to block the line of sight from such equipment to nearby off -site <br />residences/sensitive receptors. <br />• Identify minimum separation distances between mobile equipment (e.g., concrete <br />mixer trucks, concrete pump trucks, etc.) and residences/sensitive receptors. <br />Additionally, the City finds that the Project will implement the following regulatory requirements <br />RR NOW through RR N0I-3 (Draft Supplemental EIR, p. 4.9-4): <br />RR N0I-1: California Building Code: The California Building Code (CBC), Title 24, Part 2, <br />Volume 1, Chapter 12, Interior Environment, Section 1207.11.2, Allowable Interior Noise <br />Levels, requires that interior noise levels attributable to exterior sources shall not exceed <br />45 dB in any habitable room. The noise metric is evaluated as either the day -night average <br />sound level (Ldn) or the community noise equivalent level (CNEL), consistent with the <br />noise element of the local general plan. <br />The State of California's noise insulation standards for non-residential uses are codified <br />in the California Code of Regulations, Title 24, Building Standards Administrative Code, <br />Part 11, CALGreen. CALGreen noise standards are applied to new or renovation <br />construction projects in California to control interior noise levels resulting from exterior <br />noise sources. Proposed projects may use either the prescriptive method (Section <br />5.507.4.1) or the performance method (Section 5.507.4.2) to show compliance. Under the <br />prescriptive method, a project must demonstrate transmission loss ratings for the wall and <br />roof -ceiling assemblies and exterior windows when located within a noise environment of <br />65 dBA CNEL or higher. Under the performance method, a project must demonstrate that <br />interior noise levels do not exceed 50 dBA Leq(1 hr). <br />RR N0I-2: Construction Noise Sources: Section 18-314(e) of the Santa Ana Municipal <br />Code prohibits construction activities to the hours of 7:00 AM to 8:00 PM Monday through <br />Saturday. <br />RR N0I-3: Stationary Noise Sources: Section 18.312 of the Santa Ana Municipal Code <br />establishes standards for stationary noise sources. <br />Explanation of the Rationale: The rationale and facts supporting the above finding are fully <br />developed in Section 4.9, Noise, pages 4.9-20 through 4.9-32 of the Draft Supplemental EIR. The <br />following presents a summary of that rationale: <br />The Project operational noise impacts would result in less than significant impacts. The Project's <br />construction noise would not have the potential to exceed the FTA's construction noise criterion <br />of 80 dBA Leq. Furthermore, Project construction activities would comply with the construction <br />hours specified in Section 18-314(e) of the Santa Ana Municipal Code, which restricts <br />construction activities to the daytime hours of 7:00 a.m. to 8:00 p.m., Monday through Saturday. <br />The only exception would be for nighttime concrete pours, which would occur a maximum of 2 <br />nights per phase, should continuous pours be necessary for geotechnical considerations.
