Requested Corrective Actions <br /> To bring the City back into compliance with CEQA and AB 52, we demand the following <br /> immediate actions: <br /> 1. Reinstate all Kizh Nation mitigation measures as presented during consultation. <br /> 2. Remove all language originating from non-consulting entities,including Joyce Perry and the <br /> Juaneho Band. <br /> 3. Resume government-to-government consultation with the Kizh Nation within 10 days,as <br /> required by PRC §21080.3.1. <br /> 4. Adopt enforceable,tribe-specific mitigation measures that prioritize avoidance, as required by <br /> PRC §21084.3(a)and CEQA Guidelines §15126.4. <br /> 5. Issue a corrective notice reaffirming the City's legal obligations under CEQA and AB 52. <br /> Failure to take these corrective actions will leave the City vulnerable to legal challenge and judicial <br /> invalidation of the project approvals. <br /> Conclusion <br /> The City's improper reliance on unverified public comments over direct consultation with the ancestral <br /> tribe is a fundamental violation of CEQA and AB 52. <br /> Furthermore, Joyce Perry's consistent pattern of late responses and neglect of consultation deadlines <br /> demonstrates her inability to provide substantial evidence or cultural affiliation to these projects and their <br /> geographic areas.
