7. the estates, heirs, legal representatives, or assignees of any <br />employee or senior executive in the event of their death, <br />incapacity, insolvency, or bankruptcy but solely for the estates', <br />heirs', legal representatives', or assignee's liability arising out of the <br />acts committed by the employee or senior executive, in their <br />capacity as such; and <br />8. the spouse, domestic partner, or civil partner of any employee or <br />senior executive solely for such spouse's, domestic partner's, or <br />civil partner's liability resulting from a claim againstthe employee <br />orsenior executive, in their capacity as such; orthei r ownership <br />or interest in property which the claimant seeks as recovery for a <br />claim against the employee or senior executive, in their capacity <br />as such. <br />2. SECTION III, EXCLUSIONS - WHAT IS NOT COVERED, Paragraph J. INSURED VERSUS <br />INSURED, is deleted and replaced with the following: <br />INSURED VERSUS INSURED I Any claim made by or on behalf of: <br />an insured underthis Policy; however, this exclusion will not apply <br />to an otherwise covered claim made by: <br />a. an employee arising from a security failure or data <br />breack or <br />b. an additional insured; <br />any business enterprise in which you have greaterthan a twenty <br />percent (20%) ownership interest; or <br />any parent company or other entity that owns more than twenty <br />percent (20%) of an insured. <br />All other terms and conditions of this Policy remain unchanged. <br />This endorsement forms a part of the Policy to which attached, effective on the inception date of <br />the Policy unless otherwise stated herein. <br />CYUSP-50EN-000020-0623-02 Page 2 of 2 <br />
