Explanation of the Rationale: The Project would remove a number of existing trees within the <br /> rights-of-way. The Project would adhere to the following sections of the Municipal Code, which <br /> contains codes that pertain to trees within parkways and rights-of-way: Section 33-191 Damaging <br /> City Trees, Section 33-185 Street Tree Species to be Planted, and Section 33-188 Site Plan <br /> Approval, as well as Article VI I, Regulation for the Planting, Maintenance, and Removal of Trees. <br /> Therefore, the Project would not conflict with applicable tree policies. (Draft Supplemental EIR, <br /> p. 5-12.) <br /> Threshold B-6: The Project would not conflict with the provisions of an adopted Habitat <br /> Conservation Plan, Natural Community Conservation Plan, or other <br /> approved local, regional, or state habitat conservation plan. <br /> Findings: The City finds that the Project would result in no impact to biological resources related <br /> to conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community <br /> Conservation Plan, or other approved local, regional, or state habitat conservation plan. The Project would result in no impacts related to sensitive natural <br /> communities; federally protected wetlands; and conflict with the provisions of an adopted Habitat <br /> Conservation Plan, Natural Community Conservation Plan, or other approved local, regional, or <br /> state habitat conservation plan; and less-than-significant impacts related to candidate, sensitive, <br /> or special status species; migratory fish or wildlife species or wildlife corridors; and conflict with <br /> local policies or ordinances protecting biological resources.Therefore, cumulative impacts related <br /> to biological resources would be less than significant.
