AUG 0 9 2010 FOURTH AMENDMENT TO AGREEMENT <br />� THIS FOURTH AMENDMENT TO AGREEMENT is entered into on May 13, <br />t� 2010, by and between National Econ Corporation ("Consultant") and the City of Santa <br />Ana ("City"). <br />RECITALS: <br />A. The parties entered into Agreement #N-2007-078, dated July 5, 2007, (hereinafter <br />"said Agreement") by which Consultant has provided environmental remediation <br />services and hazardous materials testing. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />add compensation to provide for the uninterrupted provision of services. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />Fourth Amendment to Agreement, the parties agree as follows: <br />1. Section 2.a COMPENSATION, shall be deleted in its entirety and replaced with the <br />following: <br />"City agrees to pay, and Consultant agrees to accept as total payment for its services, <br />the rates and charges identified in Exhibit A, attached to this Agreement. The total <br />sum to be expended under this Agreement shall not exceed $8,000.00, during FY <br />2010-2011." <br />2. Section 3, TERM, shall be amended to extend the termination date through June 30, <br />2011. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect. <br />WITNESS WHEREOF, the parties hereto have executed this Fourth Amendment to <br />Agreement on the date and year first written above. <br />ATTEST: <br />1 <br />I <br />ARIA D.
