To: Honorable Mayor and Members of the Santa Ana City Council <br />From: Carlos Perea, Santa Ana Police Oversight Commissioner <br />Date: Tuesday, October 7, 2025 <br />Subject: Opposition to Agenda Item #21- Consideration of Possible Censure of Councilmember <br />Hernandez <br />Mayor Amezcua and City Councilmembers, <br />I strongly oppose the censure of Councilmember Hernandez. Using censure in response to <br />public criticism risks undermining free speech and the ability of elected officials to advocate for <br />accountability and transparency. Past incidents, including the circulation of a BOLO among <br />police officers mocking Councilmember Hernandez's late cousin, Brandon Lopez, highlight a <br />pattern of unprofessional behavior and a disturbing disregard for the dignity of individuals <br />connected to public officials. This kind of behavior erodes trust in city governance and sends the <br />wrong message to the community. <br />Elected leaders must be able to raise concerns about city operations, policies, or employee <br />conduct without fear of retaliation or intimidation. Punitive measures in response to public <br />statements or advocacy set a dangerous precedent and could chill the very oversight and public <br />accountability that the community depends on.
