AMENDMENT TO MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SANTA ANA AND THE SANTA ANA POLICE OFFICERS ASSOCIATION FOR FISCAL YEARS 1990-91, 1991-92 AND 1992-93 The "Memorandum of Understanding Between the City of Santa Ana and the Santa Ana Police Officers Association for Fiscal Years 1990-91, 1991-92 and 1992-93," executed December 10, 1990, is hereby amended in the following particulars: ARTICLE XI is amended by adding Section 11 to read as follows: Section 11. Catastrophic Leave Donation. In order to assist employees otherwise granted leave of absence without pay by the City Manager because of a catastrophic non-industrial medical condition or injury, the City and Union agree to implement a Catastrophic Leave Donation Procedure on a trial basis. The trial period shall be from April 1, 1991 through the balance of the term of this Agreement. Unless otherwise agreed to by the City and the Union, this trial period shall not extend beyond the term of this Agreement. Nothing herein shall be construed to alter City policies and procedures as provided in the Charter or ordinances of the City of Santa Ana or other provisions of this Agreement with regard to granting unpaid leaves of absence. A. Guidelines. It shall be understood that all donations under this procedure are voluntary and subject to taxation for both the donor and recipient. 1. Employees may donate vacation or compensatory time or one in-lieu holiday to the eligible employee. In no event shall sick leave be donated. 2. Employees shall be provided a two-week period to submit donations. Donations received after this two-week period shall not be processed. The two-week period for each case shall be designated by the department head or his/her designee as provided herein below. 3. Donations shall be for a minimum of two (2) hours and a maximum of eight (8) hours per donor. All donations must be made in two-hour increments, except in-lieu holidays must be for eight (8) hours. 4. Any authorization of donations not made in accordance with the procedures outlined in Section C, subparagraph 2 below, will not be processed. 5. All donations shall be irrevocable.
