the employee shall then set forth the grievance in writing, indicate the <br /> nature of the action desired, sign it, and submit it in duplicate to his or <br /> her immediate supervisor. At this point, the grievance review process becomes <br /> formal. Should the grievant fail to file a written grievance, and in the <br /> manner specified above, within ten (10) working days after first discussing <br /> the grievance with his or her immediate supervisor, the grievance shall be <br /> barred and waived. <br /> Seokjon 3. Formal_proees. <br /> A. If the grievance is not resolved through the informal process, <br /> and a written grievance is filed within the time limits set forth above, the <br /> grievant's immediate supervisor shall add his or her comments and any <br /> justification he or she consider proper, sign it, and forward it to his or her <br /> Division Commander without undue delay, or in no case, more than three (3) <br /> working days. <br /> B. The Division Commander, after study of the case, shall attach <br /> his decision and reasons therefore, and return them to the employee within <br /> three (3) working days after receipt of the written grievance. <br /> C. If no satisfactory settlement has been reached at the division <br /> level, the employee may, within six (6) working days after receipt of the <br /> Division Commander's decision and reason(s) therefor, carry the matter to the <br /> Chief of Police. To do so, the employee shall describe on separate <br /> corresponsdence, the reason why he is not satisfied, and shall submit this, <br /> with the original form through his superior officer and Division Commander to <br /> the Chief of Police. Failure of the grievant to take this action will <br /> constitute a waiver and bar to the grievance, and the grievance will be <br /> considered settled on the basis of the Division Commander's response. <br /> D. If the grievant files a written grievance to the Chief of Police <br /> in the manner and within the time limits specified in "C" above, then a <br /> conference shall be held at the request of the employee or the Chief of <br /> Police. <br /> E. The Chief of Police shall inform the employee of his action <br /> within ten (10) working days after receipt of the request for settlement. The <br /> original of the grievance form and the Chief's decision shall be filed in the <br /> Personnel Records of the department. <br /> F. If no satisfactory settlement has been reached at the <br /> departmental level, the employee may, within six (6) working days after being <br /> informed by the Chief of Police of his decision on the matter, and the reasons <br /> thereof, submit the grievances in writing to the City Manager, or his duly <br /> authorized representative, for determination. Failure of the grievant to take <br /> this action will constitute a waiver and a bar to the grievance, and the <br /> grievance will be considered settled on the basis of the Chief of Police's <br /> response. <br /> The City Manager, after a careful review, shall render a final decision <br /> on the merits of the grievance, in writing, and return it to the grievant <br /> within fifteen (15) working days after receiving the grievance. A copy of the <br /> written grievance to the City Manager, and of the City Manager's decision, <br /> shall be filed in the Personnel Records of the department and the grievant's <br /> 30 <br />
