STATEWIDE SANITARY SEWER SYSTEMS GENERAL ORDER <br /> <br />o Implementation of available equipment, technologies, strategies, and <br />recommended industry practices for maintaining and managing sewer systems to <br />preventspills, and containandeliminatedischargesto waters of the State;and <br /> The spill duration and factors beyond the reasonable control of the Enrollee causing <br />the event. <br />6.1.7.Enforcement Discretion Based on Reporting Compliance <br />Consistent with the State Water Board Enforcement Policy, the State Water Board or a <br />Regional Water Board may consider the efforts to comply with spill reporting <br />requirements when determining compliance with Water Code section 13267 and section <br />13383. When assessing Water Code section 13227 factors, the State Water Board or <br />the applicable Regional Water Board will consider: <br /> in this General <br />Order; <br /> The use of best available information for the reporting of spill start date <br />and start time in which the release of sewage from the sanitary sewer system <br />initiated; <br /> The reporting of spill end date, and end time to be the date and time in <br />which the release of sewage from the sanitary sewer system was stopped; <br /> The diligence to accurately estimate and report spill volumes; <br /> The subsequent verification and/or updates to initial Draft Spill Reports in <br />accordance with this General Order; and <br /> The timely certification of required spill reports. <br />Consistent with Water Code section 13267 and section 13383, the State Water Board or <br />a Regional Water Board may require an Enrollee to report the results of a condition <br />assessment of a specified portion <br />6.2. Other Regional Water Board Orders <br />It is the intent of the State Water Board that sanitary sewer systems be regulated in a <br />manner consistent with federal and state regulations. This Order will not be interpreted <br />or applied: <br /> In a manner inconsistent with the federal Clean Water Act; <br /> To authorize a spill or discharge that is illegal under either the Clean Water Act, the <br />Water Code, and/or an applicable Basin Plan prohibition or water quality standard; <br /> To prohibit a Regional Water Board from issuing an individual National Pollutant <br />Discharge Elimination System (NPDES) permit or individual waste discharge <br />requirements superseding an regulatory coverage under this General <br />Order for a sanitary sewer system authorized under the Clean Water Act or Water <br />Code; <br /> <br />ORDER 2022-0103-DWQ December 6, 2022 <br />30 <br /> <br />
