(9) <br />CITY OF SANTA ANA <br />B. DIR REGISTRATION <br />This project is a public work and subject to the following: No contractor or subcontractor may be <br />listed on a bid proposal for a public works project (submitted on or after March 1, 2015) unless <br />registered with the Department of Industrial Relations pursuant to Labor Code section 1725.5 <br />[with limited exceptions from this requirement for bid purposes only under Labor Code section <br />1771.1(a)]. No contractor or subcontractor may be awarded a contract for public work on a <br />public works project (awarded on or after April 1, 2015) unless registered with the Department <br />of Industrial Relations pursuant to Labor Code section 1725.5. This project is subject to <br />compliance monitoring and enforcement by the Department of Industrial Relations. Contractors <br />are further cautioned that certified payrolls shall be submitted electronically directly to the <br />Department of Industrial Relations. <br />C. CAL -OSHA VEHICLE REGULATION <br />All vehicles must meet California Motor Vehicle and Cal -OSHA regulations and all other <br />applicable codes required for vehicle use on the roads or highways in the state of California. <br />D. CARB FLEET COMPLIANCE CERTIFICATION <br />Contractor shall comply, and shall ensure all subcontractors comply, with all applicable <br />requirements of the most current version of the regulations imposed by California Air <br />Resources Board ("CARB") including, without limitation, all applicable terms of Title 13, <br />California Code of Regulations Division 3, Chapter 9 and all pending amendments <br />("Regulation"). <br />Throughout the Project, and for three (3) years thereafter, Contractor shall make <br />available for inspection and copying any and all documents or information associated <br />with Contractor's and its subcontractors' fleets including, without limitation, the <br />Certificates of Reported Compliance ("CRCs"), fuel/refueling records, maintenance <br />records, emissions records, and any other information the Contractor is required to <br />produce, keep or maintain pursuant to the Regulation upon two (2) calendar days' notice <br />from the City. <br />Contractor shall be solely liable for any and all costs associated with compliance with the <br />Regulation as well as for any and all penalties, fines, damages, or costs associated with <br />any and all violations, or failures to comply with the Regulation. Contractor shall defend, <br />indemnify and hold harmless the City, its officials, officers, employees and authorized <br />volunteers free and harmless from any claims, liabilities, costs, penalties or interest <br />arising out of any failure or alleged failure to comply with the Regulation. <br />E. QUALITY ASSURANCE <br />Contractor shall provide laborers and supervisors who are thoroughly familiar with the type <br />of construction involved and materials and techniques specified. <br />F. CONSTRUCTION WASTE MANAGEMENT <br />Contractor shall keep work areas clean and free from any debris, rubbish, hazardous waste <br />and non -usable material resulting from the work under this Contract and shall be disposed <br />of at the completion of each work day by the Contractor. Hazardous waste must be disposed <br />of in accordance with the Resource Conservation and Recovery Act and all other applicable <br />federal, state, and local laws and regulations. <br />G.
