<br /> <br /> Resolution No. 2025-10 <br />Page 1 of 11 <br /> <br />RESOLUTION NO. 2025-10 <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY <br />OF SANTA ANA APPROVING CONDITIONAL USE PERMIT NO. <br />2025-11 AS CONDITIONED TO ALLOW DRIVE-THROUGH <br />SERVICES FOR THE PROPERTY LOCATED AT 1819 NORTH <br />TUSTIN AVENUE (APN: 396-302-031 and 396-312-15) <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br /> <br /> Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines, and declares as follows: <br /> <br />A. John Caglia, representing Dutch Bros Inc. (”Applicant”), on behalf of Hall John <br />C Trust (“Property Owner”), is requesting approval of Conditional Use Permit <br />(“CUP”) No. 2025-11 to allow drive-through window service for an eating <br />establishment in the Community Commercial (C-1) zoning district located at 1819 <br />North Tustin Avenue (“Project”). <br /> <br />B. In 2019, the City of Santa Ana annexed Assessor Parcel Nos (APNs) 396-302-03 <br />& 396-312-15, previously under the jurisdiction of the County of Orange. Both sites <br />are currently vacant parcels. <br /> <br />C. On April 2, 2024, the Applicant submitted Development Project (DP) application <br />No. 2024-06 to the City. Since then, the Applicant has worked with City staff on <br />addressing various agency comments. <br /> <br />D. Santa Ana Municipal Code (“SAMC”) Section 41-365.5(e) requires approval of a <br />CUP for eating establishments located within the C-1 zoning district with drive- <br />through window service. <br /> <br />E. Pursuant to SAMC Section 41-638, the Planning Commission is authorized to <br />review and approve the CUP for this Project as set forth by the Santa Ana <br />Municipal Code. <br /> <br />F. On April 28, 2025, the Planning Commission held a duly noticed public hearing for <br />CUP No. 2025-11. <br /> <br />G. The Planning Commission of the City of Santa Ana has considered the information <br />and determines that the following findings, which must be established in order to <br />grant CUP No. 2025-11, for drive-through window service, have been established <br />as required by SAMC Section 41-638. <br />1. That the proposed use will provide a service or facility, which will contribute <br />to the general wellbeing of the neighborhood or community.
