<br /> <br /> <br />Resolution No. 2025-10 <br />Page 8 of 11 <br />EXHIBIT A <br /> <br />Conditions of Approval for Conditional Use Permit No. 2025-11 <br /> <br />Conditional Use Permit (“CUP”) No. 2025-11 for drive-through window service is approved <br />subject to compliance, to the reasonable satisfaction of the Planning Manager, with applicable <br />sections of the Santa Ana Municipal Code, the California Administrative Code, the California <br />Building Standards Code, and all other applicable regulations. In addition, they shall meet the <br />following conditions of approval: <br /> <br />The Applicant must remain in compliance with all conditions listed below throughout the life <br />of the conditional use permit. Failure to comply with each and every condition may result in <br />the revocation of the conditional use permit. <br /> <br />1. The Applicant must comply with all conditions and requirements of the Development <br />Review Committee for the Development Project (DP) No. 2024-06. <br /> <br />2. Any proposed amendment to this conditional use permit must be submitted to the <br />Planning Division for review. At that time, staff will determine if administrative relief is <br />available or if the conditional use permit must be amended. <br /> <br />3. Prior to the issuance of a Building Permit, the Applicant shall submit a landscape and <br />irrigation plan for the entire site to the Planning Division for review and approval. The <br />landscape and irrigation shall comply with the zoning district's landscape standards, <br />the Water Efficient Landscape Ordinance (WELO), and the Citywide Design <br />Guidelines. The landscape plan shall also include a proposal for a diverse selection of <br />shade-producing trees, reviewed and approved by the Planning Division and <br />enhanced buffer shrubs/vines in conjunction with appropriately sized fencing <br />alongside the southern property line from Tustin Avenue until the location of where the <br />In-N-Out building begins, in an effort to mitigate and discourage any unsafe crossing <br />of pedestrians through the drive aisle connecting the Dutch Brother’s site and 1809 <br />North Tustin Avenue (In-N-Out site). <br /> <br />4. Prior to issuance of a Certificate of Occupancy, the Applicant shall install signage <br />instructing pedestrians to use the designated sidewalk in an effort to mitigate and <br />discourage any unsafe crossing of pedestrians through the drive aisle connecting the <br />Dutch Brother’s site and 1809 North Tustin Avenue (In-N-Out site). Such signage shall <br />be subject to review and approval by the Planning and Building Agency. <br /> <br />5. The Applicant shall, beginning from the date of issuance of the Certificate of <br />Occupancy, until a period of six (6) months, implement a separate Grand Opening <br />Traffic Management Plan that addresses onsite emergency overflow scenarios in <br />which encroach upon the public street. This separate traffic management plan shall <br />be reviewed and approved by the Planning Division, Public Works Agency Traffic <br />Division, and the Santa Ana Police Department. The Grand Opening Traffic <br />Management Plan shall include increased staff to provided traffic control throughout <br />operating hours to assist with vehicular overflow should patron vehicles encroach into
