_____________________________________________________________________________________________________________________ <br />CONFIDENTIAL ASSOCIATION OF SANTA ANA (CASA) MOU: JULY 1, 2025 THROUGH JUNE 30, 2028 <br />Page 39 <br />13139922.1 SA370-001 <br />For the purposes of this section only, a “day” shall be defined as the number of <br />hours of work that an employee is required to work according to their specific <br />workday schedule. <br />K.Payment for Unused Sick Leave. For all employees in the Association employed <br />by the City in a full-time position as of July 19, 2023: <br />1.Except in cases of disability retirement, upon non-disciplinary termination <br />of employment payment of all unused sick leave shall be deposited in either <br />the employee’s individual (RHS) account, or 457 deferred compensation <br />account, or cash upon their effective date of termination as follows: <br />2.Payment after ten (10) years After ten (10) years of cumulative full-time <br />service with the City, each qualified employee shall be entitled to payment <br />for fifty percent (50%) of the total sick leave benefit credited into either, 1) <br />their individual RHS account or, 2) their individual 457 deferred <br />compensation account, or 3) cash, upon the effective date of such <br />termination, not to exceed a maximum limit of six hundred forty (640) <br />hours, at the base rate of pay effective on the date of such termination. <br />3.Payment after fifteen (15) years. Affected employees who have completed <br />fifteen (15) years of cumulative full-time service with the city shall be <br />entitled to payment for one hundred percent (100%) of the total accrued <br />unused sick leave benefit credited into either, 1) their individual RHS <br />account or, 2) their individual 457 deferred compensation account, or 3) <br />cash, upon the effective date of their termination, not to exceed a maximum <br />limit of one thousand six hundred (1,600) hours, at the rate of base pay <br />effective on the date of such termination. <br />4.Employees who notify the City, in writing, of their intent to retire within <br />twelve (12) calendar months from the date of retirement shall be allowed to <br />cash out any eligible sick leave bank balances (Sections 11.1(K)(1) through <br />11.1(K)(5)), upon request. Employees shall receive payment the first <br />paycheck in January after the request has been made. If the employee <br />cashes out their eligible sick leave bank balances prior to retirement and <br />subsequently does not retire from the City, all future sick leave accrual for <br />the employee shall be subject to the same cash out provision elected and <br />will be processed on the final paycheck. All combined cash outs cannot <br />exceed what the employee would have been entitled to if the cash out was <br />processed on the final paycheck only. <br />5.A lump sum payment shall be made to the beneficiaries of any eligible <br />employee whose death occurs while such employee is an active employee <br />of the City, such payment to be in the amount of one hundred percent <br />(100%) of the total sick leave benefit credited to the employee’s account at <br />the time of their death, and at the rate of pay effective on the date of death.
