When an on-duty employee is called to serve as a juror or non- <br />party witness in any court action, they shall be allowed to leave for the time actually <br />required for such service without loss of pay. Each on-duty employee called for such <br />service shall present to their Department Head for examination the subpoena calling them <br />to such service and shall pay into the City Treasury the fees collected for such service, with <br />the exception of reimbursement for transportation expenses, if any. <br />If an employee is called to serve on jury duty during a normal Friday off, or a Saturday, or <br />Sunday, or on a City holiday, then the jury duty shall be considered the same as having <br />occurred during the employee’s day off work. <br /> Examination Leave. Employees participating in examinations conducted during their <br />normal working hours for positions in the competitive service of the City of Santa Ana <br />shall be granted leave with pay for the time actually required without loss of any accrued <br />vacation time off benefits. <br /> Unauthorized Absence. Unauthorized absence from duty for any duration of time may be <br />considered cause for dismissal. Unauthorized absence from duty for a consecutive number <br />of working hours equal to the number of working hours in the employee’s normal <br />workweek (five (5) consecutive working days) may be deemed a resignation from City <br />service; provided, however, if upon return to duty the person so absenting themselves <br />makes an explanation satisfactory to the Department Head regarding the cause of their <br />absence, the Department Head may restore them to their position, with the City Manager’s <br />approval. <br /> Authorized Absence Without Pay - Short Term. Absence without pay not to exceed five <br />(5) consecutive working days may be authorized by the employee’s Department Head. <br />Absence without pay not to exceed fifteen (15) calendar days may be authorized by the <br />Department Head with the approval of the City Manager. Such an absence may be <br />authorized only if in the judgment of the Department Head it serves the best interest of the <br />City. <br /> Authorized Absence Without Pay - Long Term. Upon receipt of a written request from an <br />employee having permanent status, plus action by the Department Head recommending <br />approval of the request, the City Manager may grant a leave of absence without pay for up <br />to six (6) months. <br />An employee returning to duty with the City shall inform the Department Head and the <br />Executive Director of Human Resources of their intention at least thirty (30) calendar days <br />prior to the expiration of the six (6) month period, or shorter period if the full six (6) months <br />is not taken.
