Fourth Street) <br />October 13, 2025 <br />Page 5 <br />5 <br />3 <br />3 <br />2 <br />noise impacts to the residents of the Rafferty. These impacted evening hours will reduce <br />potential disturbances in observance of the typical Monday through Friday work schedule. <br />The applicant has been informed of the condition prior to the Planning Commission <br />meeting and will have the opportunity to voice their position at the public hearing. <br />The proposed after-hours operations will not be detrimental to those living or working in <br />the area because conditions have been placed to mitigate any negative impacts on the <br />community. These conditions are consistent with other eating establishments that have <br />similar hours of operation and similar operational conditions. Further, the building’s <br />location in the heart of the Downtown Santa Ana commercial area mitigates several <br />possible impacts from late-night operations. The primary eating establishment activity <br />takes place within the existing commercial tenant space, and is set back from Fourth <br />Street, away from sensitive uses. Further, the Project site is surrounded by other <br />commercial uses and public facilities. As a result, the granting of CUP No. 2025-19 will <br />not negatively impact any sensitive land uses. <br />Public Safety <br />In addition to the land use and operational findings above, staff has also considered public <br />safety. Staff recognizes that Downtown Santa Ana, like other active urban areas, <br />experiences ongoing challenges related to nightlife uses, including public intoxication and <br />other disturbances. To proactively address such concerns and ensure that this <br />establishment contributes positively to the Downtown environment, staff has <br />recommended additional operational conditions in Exhibits 1 and 2. These include the <br />presence of licensed security personnel, enhanced exterior lighting, security cameras, <br />closing procedures, and appropriate signage. <br />Together, these measures are intended to maintain a safe and welcoming environment <br />for patrons and nearby residents, while ensuring continued compliance with State law <br />and the SAMC. By requiring these safeguards at the outset, the Project will operate <br />compatibly within the mixed-use Downtown setting and mitigate potential negative <br />impacts, thereby protecting the health, safety, and welfare of the community. <br />General Plan Consistency <br />Approval of the requested CUPs is consistent with the General Plan land use designation <br />of District Center (DC) which is categorized as major activity areas in the City that are <br />designed to serve a mix of uses including retail and commercial uses, particularly along <br />arterial transportation corridors. The Downtown District portion of DC serves as one of <br />the County’s major employment and governmental operations centers that is <br />complemented with a mix of residential, commercial, and service uses to enhance its <br />urban vibrancy. The proposed sale of beer and wine for on-premises consumption and <br />after-hours operation at the subject eating establishment will serve a commercial use and <br />would contribute positively to the City’s business landscape and tax base. <br />
